Medigap rights when your Medicare Advantage plan leaves your area
When a Medicare Advantage plan leaves your area, you generally have a guaranteed-issue window to buy a Medigap policy without being turned down for your health. It starts before your coverage ends and runs for about 63 days after.
How the window works
The window generally begins about 60 days before your coverage ends and continues for 63 days after. Insurers selling in your state cannot deny you or charge more because of your health during it, for the plans the rule covers.
Why people look at it
- Going back to Original Medicare removes the network limits of an Advantage plan.
- A supplement can pay much of what Original Medicare leaves unpaid.
- You would also need a separate drug plan, since Medigap has none.
Have this ready when you call
- Your plan's notice with the end date
- Your date of birth
- Your ZIP code
- Your medicine list
Common questions
Do I have to buy a Medigap policy?
No. It is one option. Staying with a Medicare Advantage plan from another company is another.
What if the window passes?
In most states an insurer can then ask health questions and decline you. Ask about your state's rules.
